Commercial Driver's License (CDL) Holders

 

If you hold a Commercial Driver's License (CDL), you are held to a higher standard of driving conduct and safety, not only while you are operating a Commercial Motor Vehicle (CMV) but also while you are driving your personal vehicle (non-CMV). In addition to obeying all of the traffic laws that non-CDL drivers must obey, you must also adhere to more strict federal regulations or else you risk losing your CDL privileges. A CDL Disqualification may result if a driver is administratively determined to have committed or gets a conviction for a "Major" or "Serious" Traffic Offense.

Alert to Commercial Driver's License (CDL) Holders

This warning will help to alert you to violations that are CDL "Major" or "Serious" Traffic Offenses. Be sure that you fully understand the consequences to your CDL driving privileges of any violation with this warning.

 

Non-Resident Violators Compact (NRVC)

Colorado is a member of the Non-Resident Violators Compact (NRVC), which is an agreement among 44 states regarding traffic tickets that have been issued to drivers who live outside the state where the violation occurred. The NRVC includes uniform procedures for processing traffic violations of non-resident drivers and an information database for maintaining records about the drivers.

 

Under the NRVC, if a CDL holder from another state receives a ticket for a moving traffic violation and the driver fails to take care of the ticket (by failing to appear in court, pay the fine amount, or adhere to requirements as specified in the ticket or summons), then the driver's home state will suspend the driver's CDL until the driver takes care of the outstanding ticket. Suspension of the CDL in the driver's home state will remain in effect as long as the ticket remains outstanding.

Out-of-State/Non-Colorado Residents Charged with a Colorado Traffic Violation

Some types of traffic violations are Traffic Infractions and do not require a court appearance. These types of tickets can be settled by mailing in a penalty assessment fine amount by the specified date listed on the ticket. If you ignore these types of tickets, serious consequences may result: A default judgment may be entered against you, the judgment may be sent to bill collections which will most likely increase the amount due, and your license in your home state may be suspended in accordance with the Non-Resident Violators Compact (NRVC).

 

Other types of traffic violations are Misdemeanor Traffic Offenses, Unclassified Misdemeanors or Felony criminal charges which require a mandatory court appearance. These types of tickets cannot be settled by a mailed-in payment of a fine amount. In some cases (more serious violations are excluded), an attorney may appear on your behalf in the court to handle your ticket, saving you the expenses and time of returning to Colorado. If you ignore these types of tickets, serious consequences may result: A warrant may be issued for your arrest; if you are picked up you may  be extradited back to Colorado or be required to post a bond, and your license in your home state may be suspended in accordance with the National Driver Register (NDR) Problem Driver Pointer System (PDPS).

 

Alert to Commercial Driver's License (CDL) Holders

Depending upon the issuing police agency (including Colorado State Patrol and most County Sheriff's Offices), if you pay the penalty assessment amount by mail, the original charge may be entered onto your driving history even though the assessed points are reduced. If you possess a Commercial Driver's License, be particularly cautious before you mail in a penalty assessment ticket because you might be admitting guilt to the original charge, which could result in a "Serious Offense" under the Commercial Driver's License (CDL) Program with a 30-day, 60-day or longer Disqualification in certain cases. Depending on the jurisdiction where the ticket is issued, an attorney may be able to get the charge reduced to a charge that is not a "Serious Offense". Regardless of whether you have a Colorado or out-of-state driver's license, be sure you fully understand the CDL consequences of mailing in a penalty assessment ticket before you do so.
